1. Agreement to these Terms

These Terms and Conditions (the “Terms”) are a binding agreement between you and AuctionXray (“AuctionXray”, the “Platform”, “we”, “us”). They govern your use of our website, the free property previews and every preliminary property report (each a “Report” or “Dossier”) that you order from us.

By creating an account, placing an order or otherwise using the Platform you confirm that you have read, understood and agree to these Terms, to our Privacy Policy and to our Refund Policy, which are incorporated by reference. If you do not agree, do not use the Platform.

You must be at least 18 years old and legally able to enter into a binding contract. If you use the Platform on behalf of a company, fund or other entity, you confirm that you are authorised to bind that entity to these Terms.

2. Who you are buying from — orders processed by Paddle

AuctionXray operates the Platform and produces the Reports. Our order process is conducted by our online reseller Paddle.com (Paddle.com Market Ltd and its affiliates, “Paddle”). Paddle is the Merchant of Record for all our orders. Paddle processes your payment, calculates and collects any applicable sales tax or VAT, issues your receipt and handles payment-related customer service, including refunds.

When you check out, the payment transaction is also subject to Paddle’s Buyer Terms. Card and bank details are entered directly into Paddle’s secure checkout; AuctionXray never sees or stores them. Your receipt and card statement may show Paddle (for example “PADDLE.NET”) as the merchant.

3. What we sell: a preliminary informational report

Each Report is an automated compilation of public government records about one specific Florida property (identified by street address or Parcel ID, county and auction type) that is, or may be, offered at a tax deed or foreclosure auction. A Report is delivered as a PDF, normally within minutes of your order, and typically includes:

• a GIS map of the official parcel polygon overlaid with the FEMA National Flood Hazard Layer, the USFWS National Wetlands Inventory, road-access and vacant-land indicators;
• the recorded instruments (mortgages, liens, judgments, releases) that our automated searches found in the County Clerk’s Official Records index and in the County Property Appraiser records for the owner names and legal description, with copies of key pages where they could be retrieved;
• an indication, under the Florida statutes cited in the Report (Fla. Stat. §197.552 for tax deed sales, §45.031 for foreclosure sales), of which recorded debts appear likely to survive the sale based on the records found;
• an automated valuation estimate and comparable sales obtained from third-party market data;
• a screening classification and a transparent, arithmetic “maximum bid” calculation based on inputs that you can edit.

If the same property was fully audited by our system within the previous 72 hours, your Report may be delivered immediately from that recent compilation instead of a new search.

The Report is a preliminary screening tool meant to help you decide whether a property deserves deeper due diligence. It is not a substitute for a title search, title insurance, a survey, an inspection or professional advice (see Section 5).

4. Prices, credits and subscriptions

Reports are purchased with credits: one credit produces one Report for one property. Prices are in US dollars and exclude any sales tax or VAT, which Paddle calculates at checkout according to your location. The price displayed at checkout is the price that applies to your order.

The first-report price may be used once per account. Credits from one-time purchases do not expire while your account is active. The Pro subscription is billed monthly in advance through Paddle and renews automatically until you cancel; credits are added to your account on each successful payment. You can cancel at any time from the link in your Paddle receipt or by emailing support@auctionxray.com; cancellation takes effect at the end of the current billing period and you keep the credits already granted.

A credit is consumed when your order is accepted. If our systems cannot produce the Report because the county records website is unavailable, the credit is returned to your account automatically (see our Refund Policy). We may change prices for future purchases at any time; a change never affects credits you have already paid for.

5. Not legal advice, not title insurance, no guarantee of auction outcome

Every Report carries the following Disclaimer, which you accept at checkout and which forms part of these Terms:

DISCLAIMER: This report is an automated compilation of public government records (County Clerk, Property Appraiser, FEMA NFHL, and USFWS NWI) for preliminary informational screening only. It is NOT a Title Insurance Policy, NOT an Abstract of Title, and NOT a Legal Opinion. Public records may contain indexing errors or unrecorded municipal liens. User agrees that Platform's maximum total liability for any error or omission is strictly limited to the amount paid for this individual report ($29.00).

AuctionXray is not a law firm, title insurer, title agent, abstractor, surveyor, appraiser, real-estate broker or financial adviser, and no attorney–client, fiduciary or advisory relationship is created by your use of the Platform. In particular:

• A Report is not a Title Insurance Policy, not an Abstract of Title and not a Legal Opinion. We do not certify title, we never state that title is “clear”, “clean” or “marketable”, and we do not insure against any defect.
• A Report states only what our automated searches found, and did not find, in the specific public indexes searched. Public records may contain indexing errors, missing or mis-filed documents, and unrecorded municipal liens, code-enforcement fines or utility charges that no public-records search can reveal.
• Statements that a lien “appears to survive” or “appears to be extinguished” are classifications produced by deterministic rules applied to the cited Florida statutes and the records found. They are not legal conclusions and may be marked as uncertain.
• The screening labels (such as GO, CAUTION or NO-GO) and the maximum-bid figure are the output of published, deterministic rules and simple arithmetic on inputs that you control. They are not recommendations to bid, not to bid, to buy, or how much to pay.
• We make no guarantee about the outcome of any auction, about the condition, value, occupancy, zoning, buildability or marketability of any property, about the accuracy of third-party valuations, or about your ability to take possession, obtain financing, evict occupants or resell.
• A Report is not a “consumer report” under the Fair Credit Reporting Act and must not be used to decide eligibility for credit, insurance, employment or housing, nor for any purpose governed by the Driver’s Privacy Protection Act.

Always consult a Florida-licensed real estate attorney or a title company before bidding on, or buying, any property.

6. Accounts and the free preview

You sign in with a one-time link sent to your email address. Keep access to that mailbox secure: anyone who controls it can access your account, credits and Reports. Tell us immediately at support@auctionxray.com if you suspect unauthorised use.

The free preview shown before purchase is a limited, rate-limited extract of the same public records and is provided for information only, with no obligation to buy. We may limit, suspend or close accounts that abuse the preview, create multiple accounts to repeat the first-report price, or otherwise breach these Terms.

7. Acceptable use and licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to download and use each Report you purchase for your own evaluation of the property it describes, including sharing it with your own advisers, lenders or partners in that transaction. You may not:

• resell, sublicense, publish or systematically redistribute Reports or the data in them, or offer them as part of a competing service;
• access the Platform by scraping, bots, scripts or other automated means, or attempt to circumvent the preview rate limits, the paywall, authentication or any other security measure;
• reverse engineer, copy or create derivative works of the Platform or the Report format;
• use the Platform or any Report to harass, threaten, stalk or discriminate against any property owner, occupant or other person, or for any purpose regulated by the FCRA or the DPPA;
• use the Platform in breach of any law, or submit information you are not entitled to submit;
• remove the Disclaimer or any notice from a Report.

The software, design, text, report templates, trademarks and compilations on the Platform belong to AuctionXray or its licensors. The underlying public records remain public; our licence covers our compilation, formatting and analysis of them.

8. Refunds

Our Refund Policy is part of these Terms. In short: if the county records website is unavailable and the Report cannot be produced, 100% of the credit is returned to your account automatically. Once a Report has been generated and made available to you, the service has been fully performed and the purchase is not refundable, except where applicable law requires otherwise. Approved refunds are processed by Paddle to your original payment method.

9. Third-party data and service availability

Reports depend on government websites (County Clerk, Property Appraiser, FEMA, USFWS), third-party market data and infrastructure providers that we do not control. These sources may be slow, unavailable, incomplete or changed without notice. We use reasonable efforts to keep the Platform available, but we do not promise uninterrupted or error-free operation, and delivery times are estimates. Links to third-party sites are provided for convenience and we are not responsible for their content.

10. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM, THE FREE PREVIEW AND EVERY REPORT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY REPORT IDENTIFIES EVERY LIEN, ENCUMBRANCE, DEFECT OR RISK AFFECTING A PROPERTY.

11. Limitation of liability

You agree that AuctionXray’s maximum total liability to you for any error or omission in a Report, and for any other claim arising out of or relating to the Platform or these Terms, whether in contract, tort (including negligence), statute or otherwise, is strictly limited to the amount paid for the individual Report concerned ($29.00), as stated in the Disclaimer you accept at checkout.

TO THE FULLEST EXTENT PERMITTED BY LAW, AuctionXray AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF PROFITS, LOST BIDS OR DEPOSITS, SURVIVING LIENS, EVICTION OR HOLDING COSTS, REPAIR COSTS, DIMINUTION IN VALUE, OR LOSS OF DATA OR BUSINESS, ARISING FROM YOUR PARTICIPATION IN ANY AUCTION OR YOUR PURCHASE OF ANY PROPERTY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the smallest amount permitted by law. Paddle’s liability for the payment transaction is governed by Paddle’s Buyer Terms.

12. Indemnity

You will indemnify and hold harmless AuctionXray and its owners, officers, employees and contractors from any claim, loss, liability or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of a Report or the Platform, or your participation in any auction or property transaction.

13. Suspension and termination

You may stop using the Platform at any time and may ask us to delete your account (see the Privacy Policy). We may suspend or terminate your access if you breach these Terms, if the law requires it, or if we discontinue the service; in the last case we will refund unused paid credits through Paddle. Sections 5, 7 and 9 to 16 survive termination.

14. Governing law and disputes

These Terms, and any dispute arising out of or relating to them or to the Platform, are governed by the laws of the State of Florida, United States of America, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in the State of Florida and waive any objection to venue there, except that either party may seek injunctive relief in any competent court.

Before filing a claim, you agree to contact us at support@auctionxray.com and to attempt in good faith to resolve the dispute informally for at least 30 days. The payment transaction itself is additionally subject to Paddle’s Buyer Terms.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page identifies the current version. Material changes are posted on this page before they take effect and, for subscribers, notified by email. Your continued use of the Platform after a change means you accept the updated Terms. The version of the Disclaimer you accept at checkout is recorded together with your order.
